Border control: Leaving Ukraine

As of 24 February 2022, martial law has been introduced in Ukraine. As a result, men between the ages of 18 and 60 are prohibited from leaving the territory of Ukraine. However, this rule does not apply to foreigners, who are still free to leave the country.

Article 10. Border control of foreigners and stateless persons when leaving Ukraine

Border control of foreigners and stateless persons when leaving Ukraine involves checking

  • availability of a valid passport document;
  • no restrictions on leaving Ukraine;
  • compliance with the requirements for the period of stay in Ukraine.


Article 13. Verification of Compliance with the Rules and Period of Stay of Foreigners and Stateless Persons on the Territory of Ukraine





  1. The absence of a mark in the passport document of a foreigner or stateless person residing on the territory of Ukraine on crossing the state border to enter Ukraine is the basis for verification of compliance with the rules and duration of stay on the territory of Ukraine.
  2. Compliance by a foreigner or a stateless person with the rules and duration of stay on the territory of Ukraine is confirmed by presenting any document confirming the fact and date of crossing the state border and/or the legality of stay of a foreigner or a stateless person on the territory of Ukraine during a certain period, or in another way not prohibited by law. In this case, the foreigner or stateless person is issued a document confirming the legality of his or her stay in Ukraine in the form and in accordance with the procedure determined by the central executive body for state border protection.
  3. Foreigners or stateless persons who fail to confirm that they have complied with the rules and duration of their stay in Ukraine are held liable in accordance with the law.

Article 19 Issuance of a stateless person's certificate for travelling abroad

A stateless person who permanently or temporarily resides on the territory of Ukraine but does not have a travel document is issued a stateless person's certificate for travelling abroad, which is a document certifying a stateless person when crossing the state border of Ukraine and staying abroad.

Article 22. Departure from Ukraine

1. Foreigners and stateless persons who legally reside in Ukraine have the right to leave the territory of Ukraine freely in accordance with the established procedure, except in cases established by law.

2. A foreigner or stateless person is not allowed to leave Ukraine if:

he/she has been notified of suspicion of committing a criminal offence or a criminal case is being considered by a court - until the end of the criminal proceedings;

he/she has been convicted of a criminal offence - until serving the sentence or being released from punishment;

his/her departure is contrary to the interests of ensuring the national security of Ukraine - until the circumstances preventing his/her departure cease.

3. The departure from Ukraine of a foreigner or stateless person may be temporarily postponed by a court decision until the fulfilment of his/her property obligations to individuals and legal entities in Ukraine, unless otherwise provided for by international treaties of Ukraine.

4. If there are grounds specified in parts two and three of this Article, information about the foreigner or stateless person shall be entered into the database of persons who are not allowed to enter Ukraine or temporarily restricted from leaving Ukraine in accordance with the legislation of Ukraine.
